Tenants And Obligation To Pay Rent

Tenant and landlord are the two most common terms that are widely used in a rental agreement. A landlord is described as the owner of the property and the tenant is the person who has taken the property on lease in exchange for rent.

Both the landlord and the tenant are legally bound by a written document called as the rental agreement.

Apart from other details that are included in the rental agreement, the document also contains certain rules and obligations that must be followed by the tenant and the landlord. These obligations are separate for both the parties. Violation of these obligations can result in an eviction notice. The most important obligation for a tenant is the obligation to pay rent. The amount of the rent to be paid to the landlord must be specified in the rental agreement. Also to be included in the document is the frequency of rent payment. A rental agreement is made for a specified period of time, after which, the agreement has to be renewed. The rules of tenancy, including the rent, may not get changed during that period of time. In certain situations like periodic tenancy, a landlord might feel the need to increase the rent. Any such changes should be intimated to the tenant 30 days in advance.

In case the tenant fails to fulfill the obligation of paying rent on time, the landlord has every right to terminate the tenancy. He/she can do this by serving a written notice to the tenant to pay the rent or vacate the property or both. However, this notice should be given at least 20 days in advance. In case, the tenant does not pay the rent after serving the notice, the landlord can start the eviction proceedings by suing the tenant for not complying with the rental agreement and causing inconvenience.
